FTC Says Page Content Must Meet Legal Guidelines

Regardless of how large or small your business is, the FTC can take you down at any time.  December 1, 2009, FTC laws were implemented for EVERY website owner, and you are not exempt. In fact, they could be watching you as you're reading this.

I'm sure you've seen a police car sitting off the road watching cars go by. If he happens to notice one that is breaking the law, he will pull them over and issue that driver a citation. The citation could be for any one of many things that we are required to do as responsible drivers. If you tell the policeman that you didn't know you were suppose to have license tags, he most likely would laugh and keep writing because as an owner of a vehicle we are required to previously know this before getting behind the wheel.  

Websites are no different. The FTC says that you are suppose to know these laws before you open your business. That is why the penalties are so stiff, usually starting at $25,000, and there are plenty non-compliant Internet website owners paying for more FTC agents on a daily basis.  

However, the hard cold truth is that most people live with their head in the sand. They think that just because they are a “Little” guy, they don’t have to worry about posting federally mandated legal disclaimers and documents on their sites. This couldn't be farther from the truth. No longer is it legal to just post on your site the wording that you think will sound good to your customers. If you are thinking like this, you're headed for real trouble.

Such documents as Terms of Service, Privacy Policy, Children’s Privacy Policy, income Disclaimers, and Affiliation affidavits, just to mention a few.
Here's the catcher - These legal documents on your site must match legal guidlines according to your line of business.

Little Guys vs. Big Boys

The FTC is not prejudiced against the “Little Guys! In fact…they’ll take down ANYONE that snubs their nose at them. Big brother doesn’t like it when we ignore the Rules! Fines for not operating by the rules?......commonly start at $25,000+.

I hear it all the time…”But my site gets so little traffic that they’ll NEVER find me amongst the Billions of sites out there that are more prominent than mine!”

WRONG!!! Here's why:

You must understand that the FTC is a powerful governing body that is terribly understaffed. Therefore, although they DO actively look at the “Big Boy” sites all the time, they generally rely on complaints filed by consumers like you and I for their investigation prospects to increase their revenue.

If you haven't yet had a customer that was PO'd and filed a complaint, then you haven't been in business very long, don't have much of a customer base, or you are in a very strange business.

And trust me when I tell you that ANYONE can make someone angry enough for them to file a complaint!

A Daily Roll Of The Dice

It only takes ONE disgruntled customer to bring your site(s) to the attention of the powers that be. Even if the complaint is bogus and you have nothing to worry about from a suit from that customer, once you’ve been flagged, your site will most definitely get put under the microscope. It's automatic - And God help you if it’s not compliant!

Equal Opportunity Bully

So now that I have scared the hell out of some of you, it may be the one thing that will save your future. This is not a game. The FTC is an “Equal Opportunity” bully! And they’re not too proud (or Busy) to take down the “Little” guy, as well as the “Big Boys” Why? Because they get paid a lot of money every time they contact someone.

Here's the kicker. When they contact you, it's too late to redo or apologize because they have been watching you for awhile and have already built a case against you. All you can do at that point is hire a special attorney. Unless you have a lot of money or a good credit line to borrow, what's left of your future is now upside down. 

So just because you’re not running a million dollar a month site, don’t think for a moment that you don’t have to worry. You could lose everything you own, have every asset frozen, go to jail, and even your paychecks garnished immediately just because your website is non-compliant.
